Senate Bill No. 662 Summary

• Adds six new sections to Chapter 196, RSMo relating to tobacco master settlement agreement compliance, certification requirements, and enforcement mechanisms

• Requires all tobacco product manufacturers selling cigarettes in Missouri to certify annually by April 30th whether they are participating manufacturers or compliant with escrow requirements, with nonparticipating manufacturers providing detailed brand family and sales information

• Establishes a directory of compliant tobacco product manufacturers and brand families to be published by July 1, 2011, with authority to exclude manufacturers failing to meet certification or escrow fund requirements

• Makes it unlawful to affix tax stamps to or sell cigarettes from manufacturers or brand families not listed in the directory, with penalties including license revocation, civil penalties up to $5,000 or 500% of retail value, and criminal charges as a Class A misdemeanor

• Creates the Tobacco Control Special Fund for deposited profits and gains from violations, and includes provisions for state cost recovery and attorney fees in enforcement actions
