Uninsured motorists waive the ability to collect noneconomic damages against insured drivers who are at fault in motor vehicle accidents, including uninsured owners, permissive drivers, and non-permissive drivers.

Waiver does not apply if the accident was caused in whole or in part by a tortfeasor operating under the influence of drugs or alcohol, or convicted of involuntary manslaughter or assault in the second degree.

Exception applies to uninsured motorists whose previous insurance was terminated or nonrenewed for failure to pay premiums, if the insurer provided at least six months' advance notice before the accident.

Awards against insured defendants shall be reduced by the portion representing noneconomic losses, and the jury shall not be informed of the waiver or its effect on recovery.

Passengers in uninsured vehicles are not subject to recovery limitations, and recovery of economic losses or benefits-provided coverage remains available.
