Beginning with the 2008-09 academic year, each approved public institution must submit its percentage tuition change to the coordinating board for higher education by July 1st preceding the academic year.

Institutions with tuition above average tuition may not increase tuition by more than the percentage change in the Consumer Price Index or zero, whichever is greater.

Institutions with tuition below average tuition may not increase tuition by more than the product of the Consumer Price Index percentage change or zero, whichever is greater, times the average tuition.

Institutions exceeding tuition increase limits must remit 5 percent of current year state operating appropriation to the general revenue fund, unless the commissioner of higher education grants a waiver after determining extraordinary circumstances warrant the increase.

Community colleges are exempt from these provisions unless their tuition exceeds average tuition, in which case limits apply only to out-of-district Missouri resident tuition.
