HB 1017 Summary

• Establishes a "Transitional School District" in cities not within counties, subject to metropolitan school district laws, with responsibility for transitioning educational system governance from federal court control to an elected governing body.

• Changes the governing board from three appointed members to a board that includes a representative elected by the school district's governing body, with a chief executive officer added when the district loses accreditation (nominated by state board of education, appointed by governor with senate consent).

• Extends the dissolution date of the transitional school district from July 1, 2008 to July 1, 2012, and allows termination by the state board or governor if district accomplishes its purposes or fails to meet state standards, or by voters through local petition and vote.

• Prohibits property and sales tax revenues from being subject to tax abatement certificates issued after August 28, 1998, or to tax increment financing adopted after January 1, 2002 (with exception for convention headquarters hotel projects adopted before August 28, 2003).

• Requires the school district's elected board to retain three dollars per registered voter for public reporting and provides board members unfettered access to all records within seven days of request at no cost.
