Repeals and re-enacts section 208.010, RSMo, regarding eligibility determination for public assistance recipients.

Adds new subsection 5 allowing up to $9,000 placed in an irrevocable trust designated to pay for final disposition of a dead human body, funeral or burial services, facilities, or merchandise to be disregarded as an asset when determining eligibility for federally aided public assistance programs.

Requires any overages from the irrevocable trust after final disposition to be paid to Missouri up to the amount of public assistance benefits provided to the beneficiary, with any remainder paid to those designated in the trust.

Renumbers existing subsections 6 through 12 to subsections 7 through 13 to accommodate the new funeral trust provision.

Clarifies that the funeral trust exemption applies to trusts that are not preneed funeral contracts as defined in section 436.405.
