Real estate licensees are immune from liability for statements made by engineers, surveyors, geologists, environmental experts, home inspectors, and similar professionals unless the licensee employed them, selected and engaged them, or knew the statements were false.

Ordering a report or inspection alone does not constitute selecting or engaging a person for purposes of determining licensee liability.

Real estate licensees cannot be sued for information in seller's disclosures for residential, commercial, industrial, farm, or vacant real estate unless the licensee signed the disclosure or knew prior to closing that statements were false or acted in reckless disregard of their truth.

Real estate licensees acting as document couriers are not considered to be making the statements contained in those documents.
