Repeals and replaces Section 444.773, RSMo, relating to the land reclamation act and permit issuance procedures.

Director must investigate permit applications and recommend approval or denial to the commission within four weeks after the public notice period expires.

Adds grounds for permit denial if affected land is within one mile of a school, child care facility, church, nursing home, public building, or cemetery.

Commission may deny permits if applicant demonstrates a pattern of noncompliance during the five-year period preceding the application that suggests reasonable likelihood of future noncompliance.

Declares the act an emergency measure effective upon passage and approval to address health and traffic risks.
