Prohibits drivers from using hand-held electronic wireless communication devices while operating a motor vehicle in construction zones or work zones as defined in section 304.580.

Exempts authorized emergency vehicles and allows hand-held device use while moving to report illegal activity, summon emergency help, prevent injury, or relay information between transit/for-hire operators and dispatchers if device is permanently affixed to vehicle.

Defines "hand-held electronic wireless communications device" to include cellular phones, palm pilots, blackberries, and other mobile devices used for verbal or text communication, excluding devices permanently embedded in vehicle architecture.

Violations constitute an infraction and moving violation for purposes of point assessment under section 302.302.

State preempts local regulation of hand-held wireless device use in vehicles; exempts parked/stopped vehicles, law enforcement and emergency personnel performing official duties, and factory-installed GPS or digital dispatch systems.
