Repeals and replaces sections 407.1070, 407.1095, 407.1098, 407.1101, 407.1104, 407.1107, and 407.1110 relating to telemarketing and the state no-call list.

Expands definition of "residential subscriber" to include wireless telephone service in addition to traditional residential telephone lines.

Prohibits telephone solicitations via voice, telefacsimile, graphic imaging, data communication, or text messaging to subscribers on the state no-call list maintained by the attorney general.

Establishes requirements for callers using automatic dialing announcing devices (ADADs), including obtaining prior consent and disclosing the caller's identity, business name, message purpose, and goods/services being promoted.

Authorizes the attorney general to enforce violations with civil penalties up to $5,000 per knowing violation, and allows consumers to bring private civil actions for actual damages or up to $5,000 per violation.
