Exempts individuals convicted of felony drug possession or use from the federal prohibition on food stamp eligibility if they meet specific substance abuse treatment criteria.

Allows food stamp eligibility for individuals currently participating in an approved substance abuse treatment program, accepted for treatment but on a waiting list, or who have completed treatment.

Permits food stamp eligibility for individuals determined by a certified treatment provider to not need substance abuse treatment, or who are complying with all court-imposed and probation/parole obligations.

Requires applicants to provide documentary or other evidence satisfactory to the Department of Social Services and meet all other food stamp program eligibility requirements.

Directs the Department of Social Services to promulgate rules in consultation with the Division of Alcohol and Drug Abuse to implement these provisions, including criteria for determining active participation and completion of treatment programs.
