Prohibits employees under 18 years old from selling or attempting to sell cigarettes or tobacco products in the course of employment.

Persons under 18 may possess cigarettes or tobacco products only if employed by a seller and possessing them to effect a sale, or if employed by the Division of Liquor Control for enforcement purposes.

Prohibits persons under 18 from misrepresenting their age to purchase cigarettes or tobacco products.

Minors violating purchase or possession provisions are guilty of an infraction; first violation results in confiscation, second and subsequent violations require confiscation plus completion of a tobacco education or smoking cessation program if available.

Sellers of cigarettes or tobacco products are fined $250 for a first violation and $500 for second and subsequent violations when an employee under 18 effects or attempts to effect a sale.
