Property owners of land burdened by easements created after December 31, 2006, may petition a court to reclaim rights and obtain vacation of the easement if abandoned for more than 10 years, with compensation equal to the original consideration paid for the easement

Easement holders may maintain the easement by demonstrating good faith plans for future use

Property owners may waive the right to request easement vacation either in the original conveyance instrument or in a subsequent signed writing

Pipeline operators transporting petroleum or natural gas that fail to maintain an easement for 10 years are deemed to have abandoned it, automatically terminating the easement and returning rights to the property owner

Pipeline operators must pay monetary consideration equal to the original easement payment, remove any improvements made to the property, and restore the property to its original condition upon abandonment
