School districts are authorized to enter into design-build contracts as an alternative to existing procurement procedures, allowing a single contract for both design and construction services.

School districts must establish written procedures for prequalifying design-build contractors and may issue requests for proposals to a maximum of five prequalified contractors.

Design-build contracts must be awarded based on best overall value considering quality, technical skill, schedule, and cost, with technical proposals evaluated separately from cost proposals before cost bids are opened.

School districts must retain an independent architect or engineer to assist with the design criteria package, request for proposals, contractor prequalification, proposal evaluation, and contract administration; this architect or engineer cannot participate as part of the design-build contractor's team.

Payment bond requirements apply to design-build projects, with design service providers covered by the bond; performance bonds may exclude design services if the contractor carries professional liability insurance in a school district-specified amount.
