Repeals and replaces section 167.131, RSMo, to establish new student transfer provisions for pupils in unaccredited school districts.

Students from districts declared unaccredited by the state board of education may transfer to accredited schools in the same or adjoining county, with the sending district paying tuition and transportation costs.

Tuition for transfer students from unaccredited districts is calculated as the lesser of the receiving district's established nonresident tuition or the lower of the two districts' average per-pupil expenditures.

Each school district must establish admission criteria by June 30, 2011, prioritizing availability of highly qualified teachers and existing classroom space, without requiring additional teacher hiring or new classroom construction.

Transfer students from unaccredited districts may complete their current educational program in their assigned building even if the home district regains accreditation, but must return to the home district upon transitioning to a different building after accreditation is restored.
