SB 157 Summary

• Removes "and inhuman" language from the definition of cruel or excessive punishment inflicted on a child less than seventeen years old.

• Defines abuse of a child as a class C felony, unless the offense involves serious emotional injury, ritual or ceremony, or physical injury to a child under two years old (class B felony), or results in a child's death (class A felony).

• Includes photographing or filming a child under eighteen years old engaged in prohibited sexual acts or simulations thereof as child abuse.

• Defines "prohibited sexual act" to include sexual intercourse, masturbation, bestiality, sadism, masochism, fetishism, and other sexual activities or nudity depicted for sexual stimulation or gratification.

• Adds definition of "fetishism" as a condition in which erotic feelings are excited by an object or body part whose presence is psychologically necessary for sexual stimulation or gratification.
