Wineries, distillers, manufacturers, wholesalers, and brewers may provide distilled spirits, wine, or malt beverage samples off licensed retail premises for tasting purposes with no sales transactions allowed.

Product sampling is permitted on temporary licensed retail premises and tax-exempt organization premises without requiring special authorization.

On regular licensed retail premises, product sampling requires permission from the retail license holder and either a special permit under section 311.294 or a by-the-drink-for-consumption-on-the-premises-where-sold retail license.

Retailers cannot receive money or anything of value in exchange for allowing on-premises product tasting.

All employees pouring intoxicating liquor samples on licensed retail premises must complete an approved server training program, and any remaining samples must be returned to the provider after the tasting.
