Department of Social Services shall develop a program to screen and test applicants or recipients of Temporary Assistance for Needy Families (TANF) benefits who the department has reasonable cause to believe engage in illegal drug use.

Individuals who test positive for unprescribed controlled substances shall be declared ineligible for TANF benefits for three years from the date of the administrative hearing decision.

Department shall refer individuals who test positive for controlled substances to substance abuse treatment programs approved by the Division of Alcohol and Drug Abuse within the Department of Mental Health.

Department must promulgate rules to develop the screening and testing provisions, which shall comply with Chapter 536 procedures.

Rulemaking authority and any rules proposed or adopted after August 28, 2011, shall be invalid and void if the legislature's powers to review, delay, or disapprove rules are held unconstitutional.
