Repeals sections 163.036 and 163.037, RSMo and enacts a new section 163.036 regarding summer school attendance and state aid calculations.

Beginning with the 2011-2012 school year, summer school attendance can only be counted toward average daily attendance if it focuses exclusively on academic areas of study or hours required by a student's individualized education program, with curriculum based on core subject areas.

Requires school districts to verify to the Department of Elementary and Secondary Education that their summer school programs conform to academic requirements in order for summer school attendance to be included in average daily attendance calculations.

Allows school districts to continue offering nonacademic or enrichment activities during summer school at the district's own expense, but such attendance cannot be counted toward state aid calculations.

Declares the act an emergency measure effective upon passage and approval to address state funding for summer school.
