Licensed hospitals must annually administer or make available influenza immunizations to employees with direct patient contact, with immunizations offered between September 1 and March 1.

Hospitals must follow immunization recommendations established by the Advisory Committee on Immunization Practices of the United States Centers for Disease Control and Prevention.

Hospitals are not required to provide immunizations if the Department of Health and Senior Services determines vaccine supply is inadequate.

Employees may be exempted from the immunization requirement if they have prior documentation of receipt, a medical contraindication, religious objections, or written declination after receiving education on risks and benefits.

The Department of Health and Senior Services shall promulgate rules to implement this section, with all rules subject to Chapter 536 rulemaking provisions and effective only after August 28, 2011.
