Department of Social Services shall develop a program to test applicants or recipients eligible for employment and otherwise eligible for Temporary Assistance for Needy Families (TANF) benefits when a case worker has reasonable suspicion of illegal controlled substance use.

Individuals testing positive for unprescribed controlled substances shall be declared ineligible for TANF benefits for three years from the date of administrative hearing decision, after a hearing conducted under chapter 536 procedures.

Department shall refer individuals with positive drug tests to substance abuse treatment programs approved by the division of alcohol and drug abuse within the department of mental health.

Dependent children of ineligible parents retain TANF eligibility with an appropriate protective payee established; the department shall appoint a payee if the parent refuses to cooperate.

Department of Social Services shall promulgate rules under chapter 536 to implement this section, with rules becoming effective only if compliant with chapter 536 provisions and effective after August 28, 2011.
