Prohibits electrical corporations from charging ratepayers for construction in progress or costs associated with owning, operating, maintaining, or financing property before it becomes fully operational.

Requires electrical corporations seeking U.S. Nuclear Regulatory Commission early site permits to submit semi-annual monitoring reports to the Public Service Commission starting October 1, 2011, detailing work completed, total expenditures, remaining work, and anticipated costs.

Corporations must explain in monitoring reports why expenditures exceeding $40 million are prudent to obtain an early site permit.

Allows recovery of prudently incurred early site permit expenditures through ratepayer charges over a period not to exceed 20 years, with an annual return on remaining balance equal to the corporation's commission-approved return on rate base, commencing with the first general rate proceeding after the permit is obtained.

Requires electrical corporations that sell, transfer, or receive reimbursement for early site permit interests to refund ratepayers the portion of proceeds received up to the amount of expenditures previously recovered from rates.
