City or political subdivision must notify private solid waste collection entities by certified mail before annexing an area or expanding collection services where private entities currently operate.

City or political subdivision cannot commence solid waste collection for at least two years from annexation or notice of intent, unless it contracts with the existing private entity to continue services during that period.

If services are substantially the same as previously provided, the city must pay the private entity at least the amount it would have received for providing those services during the two-year period.

City or political subdivision intending to expand solid waste collection into an area served by private entities must put that expansion to a vote of the people in the affected area.

Private entities serving 50 or more residential accounts or any commercial accounts must provide requested information to the city within 30 days to help determine the nature and scope of potential contracts.
