Students denied participation in interscholastic activities due to transfer from one school to another (by persons/organizations other than parents, guardians, coaches, or schools) may petition circuit court for de novo review.

Upon student application, courts must issue temporary restraining orders prohibiting enforcement of the participation denial until final court disposition.

Judicial review must be based solely on the best interests of the student; evidence regarding impact on other parties is inadmissible.

Schools and organizations cannot penalize students, teams, or schools for allowing participation pursuant to a restraining order.

Students who prevail in court may recover reasonable attorney's fees from the organization or person who attempted to prohibit their participation; mid-season transfers are excluded from these provisions.
