Only physicians may prescribe or administer RU-486 (mifepristone) or other abortion-inducing drugs, with non-physicians violating this provision subject to class C felony charges (class B felony if administered without consent).

Physicians must perform a physical examination, document gestational age and ectopic pregnancy status, and provide patients with FDA-approved drug labels at least 24 hours before administering abortion-inducing drugs.

Abortion-inducing drugs may only be administered in hospitals or licensed ambulatory surgical centers, with facilities performing five or more first-trimester abortions monthly required to be licensed as ambulatory surgical centers.

Physicians prescribing or administering abortion-inducing drugs must have clinical privileges at a hospital within 30 miles offering obstetrical/gynecological care and must have privileges to perform surgical intervention including surgical abortion.

Physicians must maintain malpractice insurance of at least $1 million per occurrence and $3 million annually covering injury to or death of children born alive after attempted abortion, with coverage extending until the child reaches age 21 or later.
