HB 1352 Summary

• Repeals sections 191.765, 191.767, 191.769, 191.771, 191.773, 191.775, and 191.776 of Missouri's indoor clean air act and replaces them with comprehensive new smoking restrictions effective January 2, 2013.

• Prohibits smoking in all enclosed public places including bars, restaurants, health care facilities, schools, child care facilities, hotels (80% of rooms), shopping malls, sports arenas, and public transportation facilities.

• Prohibits smoking in all enclosed workplaces without exception, including common work areas, offices, elevators, hallways, and vehicles; employers must communicate this prohibition to all employees.

• Establishes 15-foot outdoor smoking buffer zones around entrances and ventilation systems of buildings, and prohibits smoking in outdoor arenas, bleachers, public transportation stations, and playgrounds.

• Creates enforcement mechanisms including fines ($50 for first violation, $100 for second within one year, $500 for third or subsequent violations), possible license suspension, and allows private citizens and employees to bring legal action; exempts private residences, tobacco retail outlets, and up to 20% of hotel and motel rooms.
