Repeals and replaces section 523.039 regarding just compensation in condemnation proceedings filed after December 31, 2006.

Establishes three methods for determining just compensation, with the highest amount applying: fair market value, fair market value multiplied by 125% for homestead takings, or fair market value plus heritage value for family-owned property held 35+ years that prevents the owner's current use.

Requires proof of family ownership through children, grandchildren, siblings, nephews, nieces, marriage, or adoption, with entities requiring more than 50% family ownership interest to qualify.

Creates new section 523.263 requiring municipalities seeking eminent domain to prove by clear and convincing evidence that a specific need exists for the particular property and that no other reasonable alternatives are viable.

Exempts the state of Missouri from the municipal eminent domain requirements in section 523.263.
