HB 1784 Summary

• Repeals and reenacts section 339.010, RSMo, which defines real estate brokers, salespersons, and broker-salespersons in Missouri.

• Adds a new exemption (subsection 7(13)) allowing unlicensed persons, associations, groups, or corporations to make communications regarding real estate without a license, unless proven by clear and convincing evidence to be false, misleading, or likely to cause specific quantifiable injury to recipients.

• Clarifies existing exemptions including property owners, attorneys, auctioneers, receivers, trustees, property managers, government employees, utilities, financial institutions, media outlets, developers, nonprofit economic development associations, and neighborhood associations.

• Maintains provisions allowing real estate salespersons compensated solely by commission to work as independent contractors with brokers.

• Prohibits real estate broker-salespersons from operating as independent real estate brokers.
