Repeals and replaces section 167.131 regarding student transfers and tuition payment in unaccredited school districts.

Exempts unaccredited districts operating under a special administrative board from paying tuition for resident students attending accredited schools in other districts during the first two school years, provided the district demonstrates improvement in annual performance report scores.

Requires districts operating under special administrative boards to resume paying tuition and providing transportation if they fail to gain at least one additional performance report point during the initial two-year period or subsequent two-year periods.

Grants students in unaccredited districts under special administrative board authority the right to transfer to higher-performing school sites within their district of residence if adequate space is available.

Declares the act an emergency measure effective immediately to clarify student enrollment options in unaccredited districts prior to the 2012-2013 school year.
