Amends Chapter 208 of Missouri law to add Section 208.021 regarding Supplemental Nutrition Assistance Program (SNAP) eligibility for households containing ineligible immigrants.

For individuals rendered ineligible prior to the Personal Responsibility and Work Opportunity Act of 1996 due to immigration status, their income and financial resources shall be counted when determining household eligibility and benefit amounts.

For individuals rendered ineligible due to immigrant status after 1996, their income and resources shall not be counted in determining eligibility, but the resulting benefit to eligible household members is capped at the amount the household would have received if the ineligible member had been included.

All rules created under this section must comply with Chapter 536 rulemaking requirements and are subject to legislative review and approval procedures.

Makes Chapter 536 and this section nonseverable, meaning if any rulemaking authority is found unconstitutional, the entire grant of authority and any rules adopted after August 28, 2012 become void.
