HB 1894 Summary

• Repeals and replaces sections 195.222 and 195.223 of Missouri law regarding drug trafficking crimes in the first and second degrees.

• Increases the cocaine base trafficking threshold from 2 grams to 36 grams for first-degree trafficking, and increases the higher threshold from 6 grams to 108 grams, with corresponding increases in second-degree trafficking thresholds.

• Establishes class A felony penalties for first-degree trafficking with mandatory sentences served without probation or parole when quantities exceed specified thresholds for heroin (90+ grams), cocaine (450+ grams), cocaine base (108+ grams), LSD (1+ gram), PCP (90+ grams or 12+ grams pure), marijuana (100+ kilograms), amphetamines/methamphetamine (90+ grams or 30+ grams near schools/housing), and MDMA (90+ grams or 30+ grams near schools/housing).

• Establishes class B and A felony penalties for second-degree trafficking (possession, purchase, or importation) based on quantity thresholds, with class A felony penalties including mandatory sentences without probation or parole for amphetamines/methamphetamine and MDMA exceeding 450 grams.

• Creates a new class A felony for possessing more than 500 marijuana plants under second-degree trafficking provisions.
