Amends Chapter 173, RSMo by adding Section 173.1225 regarding higher education course delivery priorities.

Community colleges have the ability to offer lower division courses leading to certificates or associate's degrees within their district and service area, regardless of whether the area includes portions of counties designated as part of a public university's college district.

The Department of Higher Education must assume that community colleges are the best pathway for delivering certificate and associate's degree courses absent mitigating factors.

Mitigating factors that may justify alternative delivery methods include: the course's direct relationship to a public university's mission and the nearest community college's lack of faculty or facilities to supply the course.
