No state-based health benefit exchange may be established or operated in Missouri to implement the Affordable Care Act unless authorized through a bill, initiative petition, or referendum as prescribed by the Missouri Constitution.

Authority for establishing, administering, or operating a state-based health benefit exchange cannot be based on an executive order issued by the governor.

State departments, agencies, and political subdivisions are prohibited from applying for, accepting, or expending federal funds related to health benefit exchanges unless authorized by statute or appropriations bill.

State officials and employees cannot enter into agreements to establish or operate a federally-facilitated exchange or provide assistance to federal agencies for exchange creation without statutory authority.

Taxpayers and members of the general assembly are granted standing to sue the state or any state official or agency for violations of this section.

The act becomes effective only upon approval by a majority of voters at the November 2012 election.
