SB 732 Summary

• Repeals the separate crime of trafficking cocaine base and merges cocaine base offenses into the general cocaine trafficking statute, eliminating the distinction between powder and crack cocaine for sentencing purposes.

• For first-degree trafficking, requires more than 150 grams of coca leaf mixture (rather than 2 grams for cocaine base) with sentences of class A felony, or class A felony without probation/parole if 450 grams or more.

• For second-degree trafficking, requires possession of more than 150 grams of coca leaf mixture with class B felony penalties for 150-450 grams, or class A felony for 450 grams or more.

• Renumbers remaining drug trafficking subsections to reflect the removal of the separate cocaine base provisions.

• Updates corresponding penalty enhancement sections (195.295 and 195.296) for prior and persistent drug offenders to reference the revised subsection numbers.
