Senate Bill No. 745 Summary

• Establishes section 188.125 to protect alternatives-to-abortion agencies and their officers, agents, employees, and volunteers' rights to freely assemble, engage in religious practices, and speech without governmental interference.

• Preempts political subdivisions from enacting ordinances, rules, or policies that prohibit, restrict, or interfere with alternatives-to-abortion agencies' assembly, religious practices, speech, counseling, referrals, education, or communications with clients and the public.

• Allows political subdivisions to continue enforcing zoning, land use, building codes, and fire codes provided they treat alternatives-to-abortion agencies the same as similarly situated agencies and do not circumvent the intent of this section.

• Authorizes courts to order injunctive relief, damages, reasonable attorney's fees, costs, and expenses in enforcement actions, with these remedies in addition to any other available legal remedies.

• Defines "alternatives-to-abortion agency" to include maternity homes, pregnancy resource centers, and agencies with the primary purpose of providing services or counseling to pregnant women to help them carry pregnancies to term instead of abortion and to assist with childcare or adoption.
