Repeals and replaces section 393.1075, RSMo, establishing the "Missouri Energy Efficiency Investment Act" to govern utility demand-side programs and energy efficiency investments.

Requires the Missouri Public Service Commission to permit electric corporations to implement commission-approved demand-side programs with the goal of achieving all cost-effective demand-side savings, using the total resource cost test as the preferred cost-effectiveness measure.

Allows the commission to develop cost recovery mechanisms including capitalization of investments, rate design modifications, accelerated depreciation, and utility retention of a portion of net program benefits for shareholders.

Exempts large industrial customers meeting specified demand thresholds (5,000+ kilowatts or 2,500+ kilowatts with existing efficiency programs) and interstate pipeline pumping stations from demand-side program cost allocation if they opt out in writing.

Prohibits customers who received state tax credits under sections 135.350-135.362 or 253.545-253.561 from participating in monetary incentive programs, except low-income customers; provides class A misdemeanor penalty for false documentation.
