Repeals and replaces section 167.131 RSMo to establish enrollment options for students in unaccredited districts, effective immediately as an emergency measure.

Students from unaccredited districts may transfer to accredited public schools in the same or adjoining county if they were enrolled in their home district when it was declared unaccredited or enroll after that declaration, including students entering kindergarten or first grade after the effective date.

Unaccredited districts must pay tuition to receiving districts at the lesser of the nonresident tuition rate or the lower of the two districts' average per-pupil expenditures for the most recently completed year.

Receiving districts must establish admission criteria by June 30, 2013, prioritizing availability of highly qualified teachers and existing classroom space, without displacing current resident students or requiring new teacher positions or construction.

Students must return to their home district at the beginning of the school year after their district regains accreditation.
