HB 301 Summary

• Restructures Missouri's sex crime statutes by renaming and reorganizing offenses: "forcible rape" becomes "rape in the first degree," "forcible sodomy" becomes "sodomy in the first degree," "sexual assault" becomes "rape in the second degree," and "deviate sexual assault" becomes "sodomy in the second degree"

• Expands the definition of "incapacitated" to include persons who are "incapable of consent" or "lack the capacity to consent" in sexual offense statutes, and adds "drug-induced state" as grounds for lack of consent

• Prohibits listing juvenile offenders (under age 18) on public sex offender registries and websites, with immediate removal of any currently listed juveniles; creates a petition process for juvenile offenders to seek removal from the registry after five years

• Establishes a prisoner re-entry program within the Department of Corrections for individuals released to St. Louis who have served full sentences without early release, administered through the city's Department of Health and Human Services

• Updates school discipline policies and teacher certification standards to reflect new sexual offense terminology and adds provisions requiring removal of juvenile offenders from sex offender registries effective August 28, 2013
