Uninsured motorists waive the right to collect noneconomic damages from insured drivers who comply with Missouri's financial responsibility laws when the insured driver is at fault in a motor vehicle accident.

The waiver applies to uninsured vehicle owners, uninsured permissive drivers, and uninsured nonpermissive drivers.

The waiver does not apply if the accident was caused in whole or in part by a driver operating under the influence of drugs or alcohol, or convicted of involuntary manslaughter or second-degree assault.

The waiver does not apply if the uninsured motorist's previous insurance policy was terminated or nonrenewed for failure to pay premiums unless at least six months' notice was provided before the accident.

Any judgment against an insured, compliant driver must be reduced by the portion representing noneconomic losses, though the jury cannot be informed of this waiver or its effect on the award; passengers in the uninsured vehicle are not subject to this limitation.
