Exempts persons 21 years of age or older from mandatory protective headgear requirements when operating or riding as a passenger on motorcycles or motortricycles from August 1-21 of each year on any state highway.

Requires protective headgear to meet standards and specifications established by the director when required, and mandates headgear use at all times the vehicle is in motion except during the August 1-21 exemption period.

Establishes penalty for failure to wear protective headgear as an infraction with a maximum fine of $25, with no court costs or points assessed for this violation.

Maintains existing penalties for unlicensed motorcycle operation (misdemeanor with fines up to $300 for first offense, up to $1,000 and/or jail time up to one year for second offense, and class D felony for third or subsequent offenses).
