Possession of 35 grams or less of marijuana or synthetic cannabinoids is a misdemeanor punishable by a fine not to exceed $250, with no arrest, custody, or incarceration unless the person has prior felony or misdemeanor convictions within specified timeframes.

Law enforcement officers must issue a summons instead of making an arrest for first-time marijuana possession violations under 35 grams, and convicted persons shall not lose their driver's license or be incarcerated.

Possession of marijuana drug paraphernalia is a misdemeanor with a fine not to exceed $250 under the same conditions and restrictions as marijuana possession, with similar summons-only requirements for first-time offenders.

Possession of non-marijuana drug paraphernalia remains a class A misdemeanor; using paraphernalia to manufacture methamphetamine or amphetamine is elevated to a class D felony.

A strong presumption exists that first-time violators should have their sentences suspended and be required to complete community service or controlled substance counseling instead of incarceration.
