Creates the "Brain Injury Fund" within the state treasury under the Department of Health and Senior Services to receive judgments, federal grants, private donations, and other designated moneys.

Fund moneys shall be appropriated and expended by the department for transition and integration of medical, social and educational services, outreach, and supports for individuals with traumatic brain injury and their families to live in the community.

Assesses a $2 surcharge as costs in all criminal cases, including violations of county or municipal ordinances and state criminal or traffic laws, with no waiver permitted except when proceedings are dismissed or costs are paid by the state, county, or municipality.

Requires court clerks to collect and distribute surcharge proceeds to the state treasury and credit them to the Brain Injury Fund.

Provides that unexpended balance in the Brain Injury Fund at the end of any biennium shall not be transferred to the general revenue fund.
