Defines "energy drink" as a soft drink containing 80 or more milligrams of caffeine per 8 fluid ounces that is advertised as designed to provide energy and typically includes methylxanthines, B vitamins, and herbal ingredients

First violation results in a $50 civil penalty fine

Second violation results in a $100 civil penalty fine

Third and subsequent violations result in a $500 civil penalty fine
