All employees and volunteers at inspected health care facilities must receive annual influenza vaccination within three months prior to flu season as defined by the Centers for Disease Control and Prevention.

Exemptions from vaccination requirements are available for medical contraindications (with physician documentation), religious beliefs (with written signed request), or vaccine shortages (with written documentation).

Facilities must maintain vaccination proof or exemption documentation in personnel files and are deemed non-compliant if fewer than 95 percent of personnel files contain required documentation.

Non-compliant facilities are subject to reinspection within three months, and if still non-compliant, face fines of $50 per full-time employee.

The requirement automatically expires six years after the effective date unless reauthorized by the general assembly.
