Repeals and replaces section 321.310, RSMo, governing petitions to exclude property from fire protection districts

Individual property owners may file petitions to exclude their property from a fire protection district by submitting an acknowledged petition with a deposit to cover exclusion costs

Owners of individual parcels within a residential subdivision may jointly file a petition signed by every parcel owner seeking to exclude the entire subdivision, which must include a statement from a rural, volunteer, subscription fire department, or fire protection association agreeing to provide fire protection services if approved

The fire protection district board must hold a hearing and may grant the petition if the property cannot be practically served by the district or if exclusion serves the district's best interests

The board's order must be filed with the circuit court, which shall make an order excluding the property unless it finds the board's order was unauthorized by law or unsupported by competent and substantial evidence; persons aggrieved may appeal to circuit court within 30 days for a trial de novo
