Board of Pharmacy authorized persons retain right of entry and inspection on all open premises appearing to be drug stores, pharmacies, or places dispensing drugs, pharmaceuticals, medicines, chemicals, or poisons.

Board of Pharmacy may establish a program for testing drugs or drug products maintained, compounded, filled, or dispensed by licensees, registrants, or permit holders.

Board of Pharmacy shall pay all testing costs and reimburse licensees, registrants, or permit holders for the reasonable, usual, and customary cost of the drug or drug product requested for testing.

Board of Pharmacy shall promulgate rules to implement these provisions in compliance with Chapter 536 and subject to General Assembly review and approval authority.

Any rules proposed or adopted after August 28, 2013, shall be invalid and void if rulemaking authority is held unconstitutional.
