Reclassifies nonsupport from a Class A misdemeanor (or Class D felony if arrearage exceeds twelve monthly payments) to an infraction effective August 28, 2013.

Maintains affirmative defense of inability to provide support for good cause, with burden of proof on the defendant by preponderance of the evidence.

Applies transitional provisions to defendants convicted of criminal nonsupport prior to August 28, 2013, allowing probation or parole with conditions for payment of current support and arrearages.

Permits work release for nonviolent first and second-time offenders incarcerated for criminal nonsupport committed before August 28, 2013, if they meet Department of Corrections criteria.

Requires prosecuting attorneys in counties with child support enforcement agreements to report quarterly on infraction notices issued and convictions obtained under this section.
