Creates exemption allowing individuals convicted of federal or state felonies involving possession or use of controlled substances to remain eligible for food stamp benefits under 21 U.S.C. Section 862a(d).

Eligibility requires meeting at least one condition: currently participating in an approved substance abuse treatment program, accepted and waiting for treatment entry, completed an approved treatment program, or complying with court and probation/parole obligations.

Eligibility determination must be based on documentary or other evidence satisfactory to the Department of Social Services, with applicants meeting all other program eligibility factors.

Department of Social Services, in consultation with the Division of Alcohol and Drug Abuse, must promulgate rules specifying criteria for active participation in and completion of substance abuse treatment programs.
