Repeals and replaces sections 115.124 and 115.395, RSMo, relating to candidate filing procedures and ballot order in nonpartisan and primary elections.

Allows candidates filing under subsection 2 of section 115.355 (persons with physical disabilities or armed forces members on active duty filing by certified mail) to designate a representative to draw their ballot position number at the random drawing.

Applies the candidate representative provision to both nonpartisan elections in political subdivisions and special districts and primary elections conducted by the secretary of state and election authorities.

Maintains existing procedures for ballot order determination: candidates filing on the first day of filing have their names listed by random drawing if sufficient candidates file, while later filers are listed in filing order.

Declares the act an emergency measure effective upon passage and approval to address immediate needs of candidates filing under the certified mail provision during the current filing period.
