Creates the "Brain Injury Fund" in the state treasury under the Department of Health and Senior Services to receive judgments, federal grants, private donations, and other designated moneys.

Fund moneys shall be appropriated and expended by the Department of Health and Senior Services for transition and integration of medical, social and educational services for individuals with traumatic brain injury and their families in community settings.

Establishes a $5 surcharge (increased from $2) assessed as costs in all criminal cases, county ordinance violations, and traffic law violations in the state or any county or municipality, with exceptions when proceedings are dismissed or costs are paid by government entities.

Surcharge cannot be waived and shall be collected by court clerks and deposited into the Brain Injury Fund.

Unexpended balance in the Brain Injury Fund at end of each biennium shall not transfer to the general revenue fund.
