Possession of 35 grams or less of marijuana or synthetic cannabinoids is a misdemeanor punishable by a fine not exceeding $250, unless prior criminal history or concurrent charges apply.

Persons convicted of possession of 35 grams or less of marijuana cannot be arrested, must be issued a summons only, and cannot be incarcerated or lose their driver's license if found guilty under specified conditions.

A strong presumption exists that sentences for small-amount marijuana possession should be suspended with community service or controlled substance counseling required instead of incarceration.

Possession of marijuana drug paraphernalia is punishable by a fine not exceeding $250 under the same conditions and enforcement procedures as small-amount marijuana possession.

Possession of non-marijuana drug paraphernalia remains a class A misdemeanor, with class D felony charges for possession of paraphernalia used to manufacture methamphetamine or amphetamine.
